Three Ways to Verify a Witness Statement

Attorneys hire Private Investigators to interview potential witnesses. It is much more cost effective for a PI charging $50 per hour to go around interviewing potential witnesses than it is for an Attorney charging $150 per hour because not all persons interviewed are going to make good witnesses. The PI can be of great service to the attorney in not only performing the interview but also checking the accuracy of the statement taken. This is done by checking out as many of the small details as possible as well as evaluating the conditions under which the information was obtained. There are three techniques:
1. Determine how the information was obtained. If the witness says “I saw everything.” ask what the light conditions were. Does the witness wear glasses? Was it rainy, snowing or foggy?
2. Evaluate the reliability of the witness. Does the witness have a reputation for accuracy and truthfulness or is he, say, a homeless person with possible disorientation issues. How good is his memory? Does he have any reason to lie about the matter?
3. Separate facts from opinions and evaluate the source of the information. How did the subject get the information? What degree of contact did the witness have with other witnesses, victims, or suspects who may have influenced his testimony?
